1. About Fitonomy Replies

Fitonomy Replies (also called OpenReply) is a tool operated by Fitonomy LLC, a company registered in Kosovo ("Fitonomy", "we", "us"). Fitonomy uses it to answer comments and direct messages on its own Instagram accounts. These terms apply when you receive our automated replies or open links we send you.

They don't replace Instagram's Terms of Use, which govern your use of Instagram, or the Fitonomy app's Terms, which govern the Fitonomy app. Our Privacy Policy explains how we handle your information.

2. Automated replies

Our replies are sent automatically when a comment or message contains a keyword we have set up. We aim to be accurate and timely, but we can't guarantee that a reply will be sent or that it will arrive. For example, Instagram may place a message from an account you don't follow in your Message Requests, or may not deliver it at all. We also can't guarantee that every reply will be free of errors.

Information in our replies is general information about fitness and our products. It isn't medical advice. Talk to a doctor or qualified professional before starting a new exercise or nutrition program.

3. Links and other services

Our replies may link to the Apple App Store, Google Play, fitonomyapp.com or offer.fitonomyapp.com. Those services have their own terms and privacy policies. Their terms, not these, apply to anything you buy or sign up for there.

Links in our messages first pass through openreply.fitonomyapp.com so that we can count clicks, as described in our Privacy Policy.

4. Acceptable use

Please don't use our automated replies to spam, harass or overload our accounts or systems, and don't try to access our systems without permission. We may stop replying to accounts that misuse the service. Instagram's Community Guidelines apply to everything you post on Instagram.

5. Availability

Fitonomy Replies depends on Meta's platform and on our service providers. We may change, pause or stop the service at any time, and we don't guarantee that it will always be available.

6. Intellectual property

The content of our replies, and the Fitonomy name, logos and materials, belong to Fitonomy or its licensors. You may not reuse them commercially without our written permission.

7. Liability

To the extent permitted by law, Fitonomy Replies is provided "as is", and Fitonomy is not liable for indirect, incidental or consequential damages arising from it. Nothing in these terms limits liability that cannot be limited under applicable law, and nothing in them affects your mandatory rights as a consumer.

8. Changes

We may update these terms. If we do, we'll post the new version here and update the date at the top.

9. Governing law

These terms are governed by the laws of Kosovo. The competent courts of Kosovo have jurisdiction, unless mandatory consumer law in your country of residence gives you the right to bring a claim there.
